Hmmmm....sounds like you need a new good luck charm. After action report? That is, can you dissect the events leading up to and into the event/incident to give others some insight as to what might have occurred in a way that we could apply some wisdom to avoid such a circumstance? Remember the 'chain of events'.....for instance, if you take any one of the individual problems that Titanic encountered on her maiden voyage and there might be a floating Titanic "hotel" in Long Beach today along with the QM...but the series of mishaps and seemingly insignificant problems, chained together, led to disaster......accident analysis, I guess. I know the bottom line is "some dude pulled out in front of you" but given coincidence of being at that exact time and place in the exact position to have this occur....things had to 'conspire' to arrange it that way....weather, speed, position, time, traffic, lighting, distractions, anything........yea I guess I AM an engineer at heart and probably should have taken a job with the DOT or FAA.....

OK what led up to this one is:
1. I was in the curb lane 50 feet from the busy intersection. I normally stay out of the right lane but in two blocks I had to turn right.
2. It was Dark.
3. Heavy rain. Not a torrential downpour but heavy.
4. I was on a bike with closely spaced headlights.
5. The driver of the Pickup is 87 years old. He said he did not see me.
6. About 5 weeks ago this curb lane did not go straight thru, was a right turn lane.
7. I assUmed he was staying stopped so I did not change lanes until he started to come out again then it was too late.

I just got back from the doctors. I have two fractured ribs, countless bruised muscles, a sprained left thumb, a bruised right elbow and lots of cuts and scrapes. These things I knew. Not my first fractured rib.

I also picked up the police report. He was cited for "Failure to yield the right of way" from a private driveway (7-11 parking lot). Look at this Google map:

Get enough $$$$$ for a new bike and get the Insurance company to pay pay pay! Remember your not going after the old man that hit you but the company who insures him.

I can relate to the injuries and you have my compassion and I wish you a speedy recovery...again. :roll: So, I guess you have joined the frequent patient club and your local medical facility by now. :blackeye: My second least favorite place to visit. :? I hope this doesn't mean you will be missing too much more work. You have had your share of bad luck this year and maybe it is a good thing the year is ending.

AAA road service coverage not only covers the vehicle you are with it covers your motorcycle. I had to use them once when we were out on a ride, stopped for lunch and the bike wouldn't start. Glad to hear you are relatively ok. The insurance company will make an offer, but you don't have to accept the1st offer they make. Have documentation or at the least good reasons why they need to pay you more. Very seldom is the first offer the final offer.

His insurer is Hartford, most likly AARP. Mine is Progressive. I have been told to use caution on what I say on here as others may lurk. What I post here is a permanent record and can be used any which way its needed.

I am upset that he did not look well enough to see me. I also do not hold that agianst him and would forgive him if he said he was sorry. I may send him a Christmas card with verbage of something like

" Sorry we had to meet like that on Pearl Harbor day. I am hoping that you are doing OK and are not too upset about it. I will be fine in time. My Motorcycle can be repaired or replaced but we, you and I, can not be. All I ask is that you use more caution and look for motorcycles or bicycles a bit better before turning. Thank you, Dave J"

We, my insurer and I, are going after his insurer not him. He may end up paying a bit higher premumn at renewal time, thats all it means to him. His ticket for FTYROW is about $125. I have not ruled out getting legal advice. All I want is an Honest coverage of all my bills and all damages from his insurer. I really want nothing from him hisself. Life goes on. My quality of life after this will never be the same as these body damages do not ever heal 100%.

If you were to walk up to me and hand me $50,000 and then say "You could keep the cash if we can break some ribs and mess you up some.", I'd hand the cash back to you. Its not about the money, this pain is the pits. Now if they offer me $200,000.00, I'll take it but ...... there will be some very happy Gospel Missions the next day. :D Food for the Poor is a better healer than anger, for me at least.

Dave I am with you. Money don't heal your body. That being said, get an attorney. If for nothing else than to protect you. His insurance should pay for your medical and for your bike.
If you are a member of the GWRRA, they have a great towing service that covers any vehicle you ride or drive. You don't have to own a GW to join. You just have to love to ride.

Get well soon and thanks for going to the Doctor. You can't take chances with your body and health.

Dave, I don't often do the token "oh-so-sorry" bit, but in this case you're a great guy and I genuinely hope you get well soon. No matter what 2 wheeler you wind up with next, I hope it comes with a larger Good Luck capacity than what you've been having. In the case of a 650, I bet we could help you rig up an extra tank the trunk for this. :D

First off let me say that I am glad that you are for the most part ok. I've been following this thread for a couple days and hope you heal quickly (although it takes longer w/age) and can manage to get another ride.
Next, I want to caution you in your idea to contact the gentleman who hit you. Intentions are great and everything, but I would hate for something you said or did to keep you from getting "things" covered. Insurance companies aren't in the business of paying claims, they are in the business of collecting premiums and will do whatever is necessary to avoid paying out anything. Plus, you never know if any of these injuries will linger longer than expected or cause problems for you in the future. Your idea to contact the gentleman is a wonderful idea, but is it really going to help or change anything? You didn't know him before and you most likely won't have contact with him later, so (and I hate to say it this way, but ...) what's the point? Collisions (notice I didn't use the word accident) happen!
Again, I hope you heal quickly and get back to something close to normal soon! Take Care!

I got outside and took some pictures. It may look not as bad as it really is. When I hit the truck, the fender crushed in and left the front bumper sticking out some. I wish I had pictures of the truck.

Warning, last photo is my damaged leg. Not too bad just be forewarned.


This shows where the trucks front bumper ripped thru the Tupperware. That cable over the seat is the parking brake cable, streched out of shape.The frame is ripped too.

Ouch! I feel bad for both you and Frankenburger.
I was told by a Lawyer to never contact the other party no matter what your intentions until after everything is settled. This advice served me well when my wife got hit by a Fed Ex driver who my wife said was "soo nice" after the accident and she felt sorry for him. Have patients and resist the temptation.

I have rethought the Christmas card. I have also contacted a Seattle "Injury Lawer". I know they will get 33% of my total but most times they get you more anyway. Sheesh Dave, you have had a streak of bad luck the last couple years. Just curious..........did you have a gremlin bell on your scooters? If not, I'd like to be a friend and send you one.

I'm very sorry to hear about and see the misfortune you've been through! I'm very glad you came out of it as well as you did. I'm sorry to see all the work you went through to get your scooter put together be messed up by someone not paying enough attention to what they were doing.

I have Progressive insurance on my scooter. They do offer some nice options for motorcycle and scooter riders. I've known my insurance agent for a long time and he's a lifelong long distance motorcycle rider. It's the same insurance he's always used on his motorcycles due to their coverage. He's an independent agent and he has multiple other insurance companies that he has available. I went with his advice and added the breakdown, towing and loaner rental package on my scooter coverage. It also includes towing. As others have said, the AMA has towing for all members. A tow bill like you experienced with this accident would cover the majority of the expense of a lifetime membership.

I'm glad to read you've lawyered-upped. Insurance companies love to keep hold of their money more than Scrooge before the ghosts visited him. Having a lawyer on your side will keep them leaning more towards the honest side.

Agian all of you, thanks for your best wishes.

My lawer has advised me to mind what I say. That said, I had to go to the ER tonight. There seems to be more damage that was found at the first visit. Many more bruises that were not visible then, are now. To include a 6X3 inch bruise on my right abdomin right at kidney level. Yep, got a small kidney blood leak that seems to have sealed itself up. Go ahead and say it. "DAVID, YOU SHOULD HAVE GONE TO THE ER, YA BIG DUMMY!" :D A few more problems too but not important.

The PI that came out took lots of photos of me and the bike. She is amazed that I dident lose my leg or more.

Hi Dave, sorry to hear about your face plant. Having had one the weekend before Thankgiving I know how much self inspection it brings on. I was much luckier than you. I wear ATGATT and my slide up the pavement didn't result in any damage to the me the operator and my bike came out in very good shape for a little 50 foot slide. If you have an auto club, I have AARP Motor Club it might help with the towing. AARP just sent me a check for $260 which took care of much of my $305 towing bill.

The real lesson is to not have a reason to get towed. :lol: . Good luck with your claim and healing. There are many friend, known and unkown on these forums so if problems arise be sure to let some one know so they can have an oppertunity to help.

Changing lanes was good, but I don't see any mention of what you were doing with the brakes.
Were you accelerating to get ahead of him, braking to fall behind or assuming that he was done changing lanes and held steady?
If the frame is damaged I think the bike is pretty well gone. Good luck with the personal healing.

These Frames are made of Iron much stronger then the Metal frames as long as the frame is not warped from the impact then there is a Chance of revival.....

if the frame is some what Bent out of shape then it can be welded, an Possible Cut an weld a new peace in place.

onless His insurance gives you enough money to Purchase a Brand new Frame.
